99% certain...
« on: Apr 07, 2016, 13:42:39 »
...hopefully pretty basic but can't find the reference to show my PP

He ended up 2 inches in bounds but with no swing up against the boundary fence

He claimed fence was man made and therefore an immovable obstruction from which he should get relief

My view was that boundary fences are not immovable obstructions and therefore he could only get relief as unplayable

Who is right

Thanks

you are

the bit you want is in the definition  of  "out of bounds"

Objects defining out of bounds such as walls, fences, stakes and railings are not obstructions and are deemed to be fixed. Stakes identifying out of bounds are not obstructions and are deemed to be fixed.

Not sure he'd be entitled to relief from the tree as he wouldn't have got relief from the fence.

A bit like claiming releif for a rabbit scrape in the roots of a tree from which you would be unable to play without the relief

I think I once claimed for casual water when my ball was in a puddle in the crevice of a tree. My argument was Seve would have got a drop.
